GENERAL TERMS AND CONDITIONS OTIUM HOTEL ROOSENDAAL

1.

APPLICATION OF GENERAL TERMS AND CONDITIONS

1.1. These general terms and conditions apply to all reservation requests, online orders and agreements concluded directly or indirectly with Otium Hotel Roosendaal and Vitae wellness Resorts.

1.2. Otium Hotel Roosendaal explicitly rejects the application of other general terms and conditions.

1.3. Exceptions to these general terms and conditions are only possible if the parties have agreed to them in writing.

2.

RESERVATION

2.1 Otium Hotel Roosendaal will only accept reservation requests from persons aged 18 or older. Otium reserves the right to refuse a reservation request without giving reasons.

2.2 For online bookings/reservations, the contract between Otium Hotel Roosendaal and the guest comes into effect at the moment the guest has definitively confirmed the reservation and/or payment has been made via the payment module, or a credit card has been issued as guarantee. For telephone reservations, the agreement between Otium Hotel Roosendaal and the guest is established at the moment Otium Hotel has sent the reservation confirmation to the guest by e-mail.

2.3 The guest should check the booking confirmation for accuracy. Inaccuracies should be communicated to the hotel immediately.

2.4. When booking a guest's visit online, a guest provides an expected arrival time and departure time. Any additional booked treatments at the Vitae wellness resort are scheduled between the times given by the guest. No exact treatment times are ever provided by Vitae Wellness Resorts; the guest is told these times upon arrival.

2.5. Should the scheduling of any treatment not be possible within the arrival and departure times specified by the guest, the Vitae Wellness Resort concerned will contact the guest by telephone or e-mail within two working days.

2.6 The guest shall make payment to Otium Hotel, within the period specified in the booking confirmation. Otium Hotel Roosendaal is entitled to consider the agreement as not concluded, if the hotel does not receive the agreed (partial) payment within the stipulated period. In that case, Otium Roosendaal has the right to release the served services and/or entrance access to other guests without further notice. In addition, Otium Roosendaal is entitled to charge cancellation fees.

3.

CHANGES TO THE RESERVATION

3.1 Otium Roosendaal is not obliged, after the conclusion of the contract, to make changes to the contract at the guest's request.

4.

PRICES

4.1. The guest shall owe Otium Hotel Roosendaal the agreed amount as stated on the booking confirmation.

4.2 Prices and additional costs are listed on the Otium Hotel website www.otium.nl and www.vitaewellnessresorts.nl, and are all inclusive of VAT.

4.3 Unforeseen government-imposed price increases may be passed on to the guest. All prices on the website and other expressions such as brochures, posters and leaflet, are subject to change and are subject to change. Hotel room prices change daily and are always subject to availability.

4.4 Discounts published after a reservation/booking or purchase has been made cannot be applied retrospectively.

5.

PAYMENT/CANCELLATION

5.1. If the guest is unable to attend, we ask the guest to contact the hotel by telephone.

5.2. No costs will be charged for cancelling only a sauna visit. If the guest has booked a treatment or package including treatment or a hotel room, Otium Hotel will apply the cancellation conditions stated under heading 5.3.

If the guest wishes to cancel a booking, the cancellation policy depends on the booked rate. In the case of an early bird or non-refundable rate, this is not cancellable under any circumstances. For a regular rate, the guest can cancel free of charge up to 24 hours before arrival. If the guest cancels within 24 hours before arrival, he/she is obliged to pay the amount mentioned on the booking confirmation, which has to be paid to Otium Hotel within 8 days. The flexible rate is higher than the other rates, allowing the guest to cancel free of charge until 12 noon on the day of arrival. After this time we will charge 50% of the amount mentioned on the booking confirmation, or we will move the reservation to another date free of charge by mutual agreement.

5.4. The guest shall not be entitled to a (partial) refund of the amount, if the guest has been unable to use all services and/or accommodation on his own initiative and through no fault of his own.

6.

(DOMESTIC) REGULATIONS

6.1 Guests must comply with the rules established by Otium Hotel and Vitae Wellness Resorts. These can be read on the website and in the hotel. Otium Hotel and Vitae Wellness Resorts has the right to immediately remove (or have removed) its guests from the hotel if the housekeeping rules are violated and/or instructions of the staff are not followed. In that case, the guest is not entitled to a refund of (part of) the paid reservation, or the consumptions and/or treatments already consumed.

6.2 Otium Hotel is entitled to ask the guest for valid identification before check-in. Otium is entitled to refuse access to the hotel and wellness resort concerned to clients who are unable to identify themselves.

6.3 Otium Hotel and Vitae Wellness reserve the right to make changes in the set-up and opening hours of the facilities. The guest shall allow maintenance to take place during opening hours if necessary. The guest cannot claim compensation. The need for maintenance is at the discretion of Otium Hotel management.

7.

VALIDITY

7.1 The validity of tickets and/or gift vouchers in circulation are expressly indicated on the relevant ticket and/or gift voucher. If the validity of the relevant ticket and/or gift voucher has expired, the validity cannot be extended.

7.2 A reservation/booking made is only valid on the day indicated by the Guest. The guest cannot derive any rights from the reservation on other days.

7.3. If the guest is in possession of a discount voucher, e-ticket or other gift voucher, the guest must actually hand these in when checking in, unless expressly stated otherwise. If the guest cannot hand over this discount voucher, e-ticket or other gift voucher, the hotel is obliged to charge the full rate.

8.

LIABILITY

8.1. Otium Hotel and Vitae Wellness Resorts accept no liability for theft (including theft from lockers), loss and/or damage to property or persons of any kind during or as a result of a stay at Otium hotel.

8.2. Otium Hotel and Vitae Wellness Resorts accept no liability for the fact that the guest's stay does not meet his/her expectations.

8.3. Otium Hotel and Vitae Wellness Resorts accept no liability for damage or injury caused to property or persons as a result of a stay on the premises of the respective Vitae Wellness Resort or caused by the use of the facilities present on the premises.

8.4. Otium Hotel and Vitae Wellness Resorts are not liable for claims for damages resulting from noise nuisance caused by third parties.

8.5. Otium Hotel and Vitae Wellnessresorts are not liable for damages resulting from information provided orally or by telephone by its employees.

8.6. Otium Hotel and Vitae Wellness Resorts are not liable for the disabling and/or disuse of facilities and/or amenities.

8.7. The guest is obliged to pay all extra costs resulting from the incorrect use or incorrect abandonment of the facilities.

9.

PRIVACY

9.1. In compliance with the General Data Protection Regulation, Vitae Wellnessresorts will treat the personal data of the client strictly confidential.

9.2. Personal data relating to the client's health are only collected for safety reasons and for the possible preparation of appropriate advice or treatment. These data are therefore used exclusively for that purpose and will not be disclosed to third parties without the customer's express consent.

9.3. The e-mail address provided by the client during the reservation or purchase process will be included in Otium's e-mail database, unless the guest has specifically deactivated it. Should the guest not wish to receive these emails, the customer may unsubscribe by clicking on the relevant link in any email the guest receives from Otium. Telephone or email unsubscriptions will not be considered.

9.4. By signing any direct debit authorisation for e.g. a subscription or entering into a reservation/booking, the guest agrees to the processing of the guest's personal data as previously described in these terms and conditions.

10.

COMPLAINTS

10.1. Despite the care and effort of the Otium Hotel Vitae Wellness Resorts, it may happen that the guest has a complaint. Complaints can be reported directly to the hotel's front desk. If a complaint cannot be remedied or it is not resolved to the guest's satisfaction, the guest must send the complaint in writing or send it by e-mail to the management. This course of action is absolutely necessary for the complaint to be handled properly.

10.2 In all cases not covered by these General Terms and Conditions, the management of Otium and Vitae Wellness Resorts will decide. By using the relevant Otium Hotel and Vitae Wellnessresort and all its facilities, the client accepts these General Terms and Conditions.

10.3 All agreements between the guest of Otium and Vitae Wellnessresorts are governed by Dutch law.
